Please review these Terms of Service ("Terms") carefully prior to accessing or utilizing the Veluna application, web client, or API interfaces (collectively, "Veluna", "Service", or "Veluna - AI Image & Video"). By accessing our neural generative tools, generating artwork, rendering videos, or acquiring compute tokens, you enter into a binding agreement with Veluna AI Technologies.
1. Service Description & Eligibility
Veluna delivers cutting-edge generative AI capabilities, including ultra-high-definition text-to-image synthesis, neural image-to-video rendering, smart canvas inpainting, multi-subject character consistency conditioning, and 8K super-resolution upscaling. By creating an account or using the Service, you affirm that you are at least 13 years old (or 16 years old where required by local law) and possess full legal capacity to enter into these Terms.
2. User Accounts, Subscriptions & Compute Tokens
Certain high-resolution generation pipelines, fast GPU cluster queues, and cinema video synthesis tools require an active subscription or compute token packages:
- Compute Tokens: Tokens represent a limited license to consume cloud GPU hardware resources for neural rendering computations. Tokens are non-transferable and hold no cash or statutory monetary value outside of Veluna.
- Subscriptions & Renewals: Paid plans (e.g., Weekly, Monthly, or Annual Creator passes) renew automatically through your app store provider (Apple App Store or Google Play Store) unless cancelled at least 24 hours prior to the conclusion of the active billing cycle.
- Refund Policies: Because GPU tensor computation incurs immediate, non-recoverable cloud infrastructure costs, consumed token allocations and active billing intervals are non-refundable, except where mandated by local statutory consumer protection laws or app store platform guidelines.
3. Intellectual Property Rights & Commercial Licensing
We champion the commercial sovereignty and intellectual freedom of digital creators:
- Your Inputs: You retain all proprietary rights, ownership, and copyright in and to the original text prompts, scripts, reference imagery, and source files you upload to Veluna. You warrant that you hold all required authorizations for any reference assets submitted.
- Generated Image & Video Outputs: To the maximum extent permitted by applicable law, Veluna assigns and conveys to you all rights, title, and interest in and to the visual images and synthesized video files generated through your account. You possess full commercial licensing rights to utilize, exhibit, publish, sell, monetize, and distribute your generated content.
- Service License: You grant Veluna a non-exclusive, worldwide, royalty-free license solely to host, process, cache, render, and display your assets as necessary to operate the service, deliver generation streams, and power your private portfolio gallery.
4. Acceptable Use Policy & Safety Moderation
To preserve a secure, ethical, and trustworthy creative environment, you explicitly agree NOT to use Veluna to produce, upload, or transmit:
- Child sexual abuse material (CSAM) or any content exploiting, endangering, or depicting minors in a harmful manner.
- Non-consensual sexually explicit depictions, deepfakes, or non-consensual synthetic impersonations of real living individuals.
- Content designed to harass, intimidate, defame, incite violence, or promote discriminatory hate speech against protected groups.
- Operational instructions or depictions facilitating weapons fabrication, explosive manufacturing, or cyberattacks.
- Materials that knowingly infringe upon valid third-party patents, copyrights, trademarks, or trade secrets.
- Automated scrapers, attack bots, or reverse-engineering payloads intended to intercept model weights or compromise cloud infrastructure.
Veluna reserves the right to immediately terminate offending accounts, revoke compute tokens, and report criminal violations to competent law enforcement agencies without refund.
5. Nature of Generative AI Output & Disclaimers
Generative artificial intelligence models synthesize visual imagery and temporal video based on statistical correlations within vast high-dimensional latent spaces. Accordingly:
- Outputs are inherently probabilistic. Veluna does not warrant that generated media will match your subjective preferences precisely or be completely free of minor anatomical, geometric, or temporal artifacts.
- Due to the mathematical non-determinism of neural diffusion algorithms, identical prompts submitted across different sessions may yield unique variations.
6. Disclaimer of Warranties & Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any nature, whether express, implied, or statutory, including warranties of merchantability, fitness for a specific purpose, or uninterrupted availability.
Under no circumstances shall Veluna AI Technologies, its directors, developers, or cloud infrastructure partners be liable for any indirect, consequential, exemplary, or punitive damages (including loss of business profits or creative interruptions) arising from your access or inability to access the platform, even if notified of such possibilities.
7. Termination of Service
You may discontinue your usage of Veluna at any time. We reserve the right to suspend or terminate your account access without prior notice if you materially breach these Terms or engage in fraudulent or harmful activities.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed under the laws applicable to internet software services, without giving effect to conflict of law principles. Any dispute arising out of or related to these Terms shall be resolved through good-faith informal consultation or binding arbitration.
